Daniel Perry Sentenced to 25 Years for Murder of Garrett Foster

Expert Testifies Foster Inches Away from Perry's Car Door

Austin, TX -

A Travis County jury has convicted Daniel Perry of murder in the death of Garrett Foster, a 28-year-old Black Lives Matter protester. Perry was sentenced to 25 years in prison. The jury deliberated for around an hour following two days of testimony in the trial.

The prosecution presented an expert witness, Dr. Robert Voss, who testified that Foster was only inches away from Perry's car door when he fired the fatal shot. Voss used a 3D modeling system to demonstrate the position of Foster and Perry's vehicle at the time of the shooting.

The defense argued that Perry acted in self-defense, claiming that Foster was trying to break into his truck. However, prosecutor David Delegado said there was no evidence to support this claim and that Perry escalated the situation by driving towards Foster.

Perry's sentencing comes as the United States grapples with a wave of racial justice protests sparked by the killing of George Floyd by a Minneapolis police officer in May. Foster's death became a rallying cry for protesters in Austin, and his family has called for charges against Perry to be upgraded to a hate crime.
